Smokey Tours Booking Conditions
Article 1: Registration Procedure
1.1 Smokey Tours is part of World Experience Philippines Corporation, a Filipino based NGO. We offer stand-alone tours around Metro Manila and packages that combine tours offered on our website (www.smokeytours.com) with local land transportation. Please contact us (tours@worldexperience.ph) for more information.
1.2 Standard Public Group Tours follow standard times of departure and itineraries. For Private Group Tours the times of departure and itineraries can be customized upon request.
1.3 All communication shall be done via email (or phone). All confirmation on packages and/or tour itineraries shall occur via email only.
1.4 After final agreement by both parties on the final package tour itinerary (and local transportation), the tour will be arranged. Smokey Tours can only hold onto reservations for tours and transportation seventy two hours (72) hours upon written receipt of confirmation via email.
1.5 For package tour bookings, booking is considered final once the guest has received a written confirmation via email from Smokey Tours, and Smokey Tours has received full payment. Full payment should be received by Smokey Tours within seventy two hours (72) hours after written confirmation is received from the guests, on the final itinerary. Should full payment be received by Smokey Tours after the seventy two hours (72) grace period, Smokey Tours will not be responsible for any changes to or cancellation of the tour and transportation previously tendered. Such an eventuality will render the agreed upon itinerary null and void and may lead to a renewed negotiation between both parties once again depending on the availability of the tour and/or transportation. It is further understood that such actions may result in a change in price for the package costs.
1.6 Any guest below the age of eighteen (18) should be accompanied by at least one of their parents or legal guardian.
1.7 For Booking Requests made forty eight hours (48) hours or less before tour commencement, Smokey Tours cannot guarantee that the guest can be contacted in time about tour availability.
Article 2: Price
2.1 Payment Prices are stated in the final itinerary document sent to guests. All prices quoted are in euro's or Philippine Pesos (PHP). Should payment be made in a convertible third currency, prices will be calculated based on the currency exchange rate on the day of booking using Oanda.com. In case the payment is done in a foreign currency and paid through a foreign bank, the bank may demand a small fee for the currency exchange. The fee should be paid by the guest.
2.2 Smokey Tours reserves the right to change prices wherefull payment is received after the 24-hour grace period.
2.3 Smokey Tours reserves the right to change prices, conditions and content of the package up to seven (7) days prior to the planned tour commencement date due to: a) Currency increase, b) Increase in transportation costs (i.e. fuel prices), c) Other abrupt changes to costs, and d) Unforeseen circumstances beyond Smokey Tours' control.
Article 3: Payment
3.1 By confirming the final itinerary for package tours by e-mail, guests provide consent for Smokey Tours to make a booking. Guests are thus requested to pay for the booking in full within 72 hours online of providing confirmation, or before the start of the tour in cash so that the corresponding reservation may take effect.
3.2 Payment can be made via the following options:a) in cash (PHP) at our Cash over the Counter spot(s) until 24 hours before the start of the tour, b) by online payment until 48 hours before the start of the tour c) by direct payment to the World Experience Philippines Bank account until 48 hours before the start of the tour.
3.3 In case guests want to make a direct payment to the World Experience Philippines, Corporation, please check www.worldexperience.ph for bank details.
3.4. Official Receipts are given only through our office. Please give additional information regarding Name to be put on the Official Receipt and TIN-number.
Article 4: Changes made by the guest
4.1 If guests would like to make any changes (e.g. Date of arrival or departure, extension, transfer), guests needs to contact Smokey Tours as soon as possible. Smokey Tours will be glad to assist but cannot guarantee the desired changes. This is because Smokey Tours is dependent on the availability of those and others concerned.
4.2 For every attempted change, Smokey Tours will charge a PHP 250.00 administration fee independent of the outcome of the proposed change. This amount will be added to the guest’s bill.
Article 5: Cancellation by the guest & Refunds
5.1. Cancellations of a booking by the guest must always be done by via email and with a valid reason.
5.2. No shows are considered as unvalid cancellations.
5.3. Refunds can be obtained if the cancellation is valid and the email is received 48 hours before the start of the tour.
5.4 . Refunds are possible through the Smokey Tours Refund Form or by visiting the World Experience (Smokey Tours) office in Quezon City.
Article 6: Changes and/or cancellation by Smokey Tours
6.1 Smokey Tours has the right to change the agreement and provision of services undervalid circumstances.
6.2 Smokey Tours will give notice as soon as possible by phone or email of any changes or cancellation.
6.3 In the event of a cancellation by Smokey Tours, an equal alternative shall be planned at no extra cost to the guest. It is the responsibility of the guest to confirm with Smokey Tours whether the alternative offer is agreeable or not.
6.4 If the alternative package is not agreed upon, then the full amount or part of the amount that has not yet been consumed will be refunded.
6.5 If the alternative is accepted, a new agreement or an addition to the existing agreement will be drafted. The new agreement will state the new arrangements and the changes in the costs,if applicable.
6.6 Smokey Tours shall endeavour to provide the best experience possible. However Smokey Tours will not be held responsible for any cancellation due to unforeseen un-safe circumstances, war, rebellion, terrorism, natural disasters, or acts of God.
Article 7: Liabilities
7.1 All arrangements regarding transportation, accommodation, food, drinks, shows, activities or other related services are offered by Smokey Tours with the condition that Smokey Tours and its partner organisations, agents, employees or assigns will not be held responsible for any and all loss, damages, claims, accidents, disabilities, illness, delays or cancellation due to reasons beyond the control of Smokey Tours or its partner organisations.
7.2 Smokey Tours is not responsible in any way, manner or formfor any harm or illness due to travel or stay in an area where the guest will be active.
7.3 It is the responsibility of the guest to have a valid passport, visa, insurances and safe transportation to the Philippines. Smokey Tours can provide assistance or advice but will not be liable for any and all loss or harm due to guest or third party negligence.
7.4 Guests are responsible for reaching the airport and making any flights in time. Smokey Tours can provide advice on schedules and planning but cannot be held responsible for the guest to arrive in time at the airport.
7.5 If accommodation has been accepted and realised, any costs incurred due to changes before and/or during the guest's stay will be for the accountand the responsibility of the guest.
7.6 Smokey Tours does not endorse and will not be responsible and liable for photos, copies, pamphlets and other advertising methods or content by second or third parties.
7.7 Smokey Tours will not be held liable for any additional costs guests may incur due to cancellations by second or third parties.
Article 8: Feedback
8.1 Smokey Tours welcomes valid and reasonable feedback regarding our services and packages.
8.2 Valid complaints must be emailed to Smokey Tours (info@worldexperience.ph). Complaints should be made no more than 25 days from the date of the tour to effect a proper investigation and a timely reply.
Article 9: Dispute resolution
9.1 All disputes are subject to the jurisdiction of the Philippines courts.
Article 10: Privacy
10.1 Smokey Tours is committed to respecting the guest's right to privacy.
10.2 All that is asked from guests when booking a tour with Smokey Tours in Manila is their full name, nationality, contact number while in Manila and email address. For online bookings, bank information is only used to do the Payment of the Tours. We use email addresses to send our newsletter upon request, TripAdvisor reviews and to update guests of new developments only with their permission.
10.3 We do not collect any personal information about our website's visitors.
